Appeal filed over ACC's renewable energy authority

The Goldwater Institute is continuing its fight to get Arizona’s renewable energy standards thrown out despite a September court ruling that said the Arizona Corporation Commission has the authority to set the standards and require utilities to meet them.

The Goldwater Institute is appealing that ruling.

Clint Bolick, director of the Scharf-Norton Center for Constitutional Litigation at the Goldwater Institute, said the regulations “may be the largest intrusion into private business in Arizona’s history, and consumers are picking up the tab.”

The Goldwater Institute contends that Maricopa County Superior Court Judge Joseph Heilman did not address the issue of whether the corporation commission can, under the state constitution, institute these regulations.
